It's what you DON'T say that can hurt you. You might be surprised to learn, that the most important benefit a real estate agent can provide is not bringing a qualified buyer buy your home; rather, it is the ability to protect the seller from a devastating lawsuit for failure to disclose important information to a buyer. In the reality of today's real estate world, sellers (and buyers) are legally required to disclose "material facts" to each other. A "material fact" is generally considered to be a fact that will either effect the price, or the buyer's decision to buy, or the seller's decision to sell. The seller is required to voluntarily disclose all material facts known about the property. This not only covers present conditions, but all known historical conditions about the property. Failure to disclose material facts may have serious legal and financial consequences which can occur beyond the closing. In fact, there are cases where courts have ordered sellers to pay substantial financial awards to buyers for their failure to disclose a material fact.
